Roger v. Thiel was charged by indictment with one count of robbery in the first degree and two counts of attempted murder. Thiel was convicted, following a jury trial, of the robbery charge and of two counts of assault in the third degree, a lesser-included offense of attempted murder. On appeal, Thiel asserts that the superior court erred in denying Thiels pretrial suppression motions. Thiel also challenges the admission of expert testimony at trial and contends that the trial court erred in refusing to find that the crime of hindering prosecution in the first degree was a lesser-included offense of robbery in the first degree. Finally, Thiel argues that the court erred in failing to allow him credit for time served while on release to a third-party custodian prior to trial. We affirm.
